These Terms of Service (the "Terms") form a binding agreement between you and Empiric Resource Agency LLC ("WifiInternetMobile," "we," "us," or "our") and govern your access to and use of the website at https://www.wifiinternetmobile.com, together with any related pages, tools, content, and services we make available (collectively, the "Service"). Please read these Terms carefully. By accessing or using the Service, you agree to be bound by them.

1. Acceptance of terms

By accessing, browsing, or otherwise using the Service — including by entering a ZIP code, requesting a comparison, submitting a contact form, calling a number listed on the site, or clicking a link to a provider — you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms, you must not use the Service.

We may also post additional guidelines, rules, or policies for specific features of the Service. Any such additional terms are incorporated into these Terms by reference. Where additional terms conflict with these Terms, the additional terms control for that specific feature only.

2. Description of the service

WifiInternetMobile is an independent comparison and ordering-assistance service. We are not an internet service provider (ISP) or wireless carrier. We do not own, operate, or control any network or infrastructure, and we are not affiliated with, endorsed by, or sponsored by any provider.

The Service helps you research and compare types of home internet, fiber, cable, and home Wi-Fi options that may be available at a given address, and — where you choose — helps connect you with a provider to place an order or learn more. We provide general information, editorial comparisons, educational tools, and ordering assistance. We do not deliver, install, activate, bill for, or service any internet, Wi-Fi, or mobile connection.

• We are an information and referral service, not a party to any service agreement you enter into with a provider.
• Any contract for connectivity service is solely between you and the provider you select.
• We do not set, control, or guarantee any provider's prices, promotions, plans, equipment, terms, installation timelines, or service quality.

3. No guarantee of pricing, speeds, or availability

Plans, pricing, promotions, speeds, data allowances, equipment, contract terms, and availability shown on the Service are provided for general comparison and educational purposes only. They are gathered from a variety of sources, may be incomplete or out of date, and can change at any time without notice. Availability and pricing vary by address and are subject to each provider's own qualification, credit, and serviceability checks.

Nothing on the Service is an offer, quote, or guarantee. Final pricing, promotions, terms, equipment, speeds, and availability must be confirmed directly with the provider before you order or rely on them. Speed figures, where shown, are advertised or estimated maximums and do not represent the actual performance you will experience, which depends on many factors outside our control.

• Information shown is an estimate for comparison and is not verified against your specific address or account.
• A provider may decline service, offer different terms, or quote a different price than what appears on the Service.
• Speed-test and similar tools provide approximate results only and should not be used to evaluate any particular provider's plan.

4. Eligibility

The Service is intended for residents of the United States who are at least 18 years old (or the age of majority in your jurisdiction) and able to form a legally binding contract. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.

The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.

5. User responsibilities & acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for any activity that occurs through your use of the Service and for keeping any information you submit accurate. You agree not to:

• Provide false, misleading, or fraudulent information, or impersonate any person or entity, including submitting another person's contact details without authorization.
• Use the Service to violate any applicable law, regulation, or third-party right.
• Attempt to gain unauthorized access to the Service, other users' data, or any systems or networks connected to it.
• Interfere with, disrupt, overload, or impair the Service, including through viruses, malware, denial-of-service attempts, or excessive automated requests.
• Use any robot, scraper, spider, or other automated means to access, harvest, or copy content or data from the Service without our prior written permission.
• Reverse engineer, decompile, or attempt to derive the source code of any part of the Service, except to the extent expressly permitted by law.
• Resell, republish, frame, or otherwise commercially exploit the Service or its content without our prior written consent.
• Use the Service to transmit unsolicited or unauthorized advertising, spam, or other solicitations.

We may, but are not obligated to, monitor use of the Service and may investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms — including removing content, restricting features, or suspending or terminating access without notice or liability.

6. Affiliate & commission relationships

The Service is supported in part by advertising and affiliate arrangements. This means we may earn a commission or referral fee when you order service through links, forms, or calls facilitated by the Service. These payments help us keep the Service free to use.

Compensation never changes the price you pay and does not determine our editorial comparisons, rankings, ratings, or recommendations, which reflect our team's independent assessment. Not every provider or offer we describe involves a commission, and the presence or absence of a commission does not affect how a provider is presented.

7. Intellectual property & trademarks

Except for content owned by third parties, the Service and all materials on it — including text, graphics, layouts, logos, design elements, editorial comparisons, tools, and software — are owned by or licensed to Empiric Resource Agency LLC and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial purposes, subject to these Terms.

All product names, brand names, logos, and trademarks referenced on the Service that belong to providers or other third parties are the property of their respective owners. We claim no ownership of, and no affiliation with, those marks. They are used solely for identification, comparison, or descriptive purposes, and their use does not imply any sponsorship, endorsement, or partnership.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Service without our prior written permission, except as expressly allowed by these Terms or applicable law.

8. Third-party sites & providers

The Service contains links to, and connects you with, third-party websites, providers, products, and services that we do not own or control. We provide these links and connections for your convenience only. We are not responsible for the content, accuracy, availability, products, services, privacy practices, or terms of any third party.

• Your dealings with any provider or third party — including orders, payments, installations, billing, support, and disputes — are solely between you and that third party.
• We make no representations or warranties about, and assume no responsibility for, any provider's offers, conduct, products, or services.
• Once you leave the Service or interact with a provider, that third party's own terms and privacy policies apply, and we encourage you to review them.

9. Disclaimers of warranties

THE SERVICE AND ALL CONTENT, INFORMATION, TOOLS, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any information provided through the Service — including plans, pricing, speeds, or availability — is accurate, complete, current, or reliable. Any reliance you place on such information is strictly at your own risk, and you must confirm all details directly with the provider before ordering.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, such warranties are limited to the minimum scope and duration permitted by law.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL EMPIRIC RESOURCE AGENCY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY INFORMATION OBTAINED THROUGH IT, OR ANY DEALINGS WITH A PROVIDER OR OTHER THIRD PARTY, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Because the Service is provided free of charge and we are not a party to any agreement between you and a provider, this limitation reflects a reasonable allocation of risk.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Empiric Resource Agency LLC and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any information or content you submit through the Service. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.

12. Governing law & dispute resolution

These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You and Empiric Resource Agency LLC agree that the state and federal courts located in the State of New York will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to personal jurisdiction and venue in those courts.

Before filing any claim, you agree to first contact us and attempt to resolve the dispute informally and in good faith. Many concerns can be resolved quickly this way. If we cannot resolve a dispute within sixty (60) days of your written notice, either party may pursue the claim in the courts identified above. Nothing in this section limits either party's ability to seek injunctive or equitable relief for the infringement or misuse of intellectual property rights.

13. Changes to terms

We may update or modify these Terms from time to time to reflect changes in our Service, our practices, or the law. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, provide additional notice. Material changes will take effect after a reasonable notice period. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

We may also modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

14. Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy and any additional terms referenced here, are the entire agreement between you and us regarding the Service and supersede any prior agreements on the subject.
• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be limited or eliminated to the minimum extent necessary.
• No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
